First of all, it is necessary to understand that the seller’s settlement requires two fees, one is the settlement money, which is finally given to the plaintiff, and the second is the fee for the lawyer he found.
Due to the differences in the environment, brands and specific circumstances of law firms, the settlement funds are also different. Part of the settlement is based on the frozen amount, part of the settlement is based on the sales volume of infringing products, and some of them are based on both aspects. The lawyer’s fees are analyzed according to different cases.
(1)GBC: Generally, the settlement is based on the frozen amount, and more than half of the balance is charged. However, there is also a case based on the sales volume. If the sales volume is large, the settlement will be more than the frozen balance. For example, if the seller sells 2,000 units and the frozen money is $10,000, the law firm may ask for $30,000 at the beginning of the negotiation, with a minimum of $2,000. That is to say, if the seller is frozen for $300, they will ask for a settlement of $2,000, and if the seller is frozen for $5,500, they will ask for a settlement of $5,000.
(2)eBay and PayPal: If the seller does not accept the settlement, GBC can take away all the money in the account after the default ruling. Therefore, the settlement requirement of GBC is of course the highest. If the frozen amount is less, it will all belong to the law firm, and if the frozen amount is more, the settlement fee will be more than 50%.
(3)Wish: If the seller on the platform is sued by GBC, the platform will first deduct part of the seller’s funds, and then provide the data to the law firm, and the specific deduction is stipulated by the platform, and the settlement ratio is similar to the above.
(4) Amazon: If the seller on this platform is sued by a law firm, the platform will immediately freeze the loan, and the law firm will settle on the basis of the frozen amount, and the proportion is the same as above.
(5) AliExpress: At present, AliExpress will not make a default ruling for the time being, so if you don’t settle the law firm, you won’t get paid, and the seller can’t unfreeze the funds, so the settlement threshold of GBC is relatively low. If the frozen amount is small, the settlement fee will be about 50%, and the larger the frozen fund balance, the greater the corresponding proportion of the settlement fee, but two thousand dollars is still the minimum requirement of GBC.
(6)Keith: In the past, the settlement was mainly based on freezing funds, and different stores had different minimum settlement conditions. For example, there are two shops, each of which will be fined ten dollars. If a settlement is to be made, each shop will generally be fined one thousand dollars. If the fine is large, it will cost more than 60% of the settlement money. However, they will also pay attention to sales, especially in the near future. The greater the sales, the higher the settlement will naturally be.
(7)David: This settlement is strictly based on the sales volume of infringing products. For a store with no or small sales volume, it usually needs a settlement of 2,000 to 3,000 dollars. Similarly, the higher the sales volume, the higher the settlement.
(8)EPS: settlement is mainly based on the sales volume of infringing products. The sales volume is zero, and the demand for settlement money will not be very high, but there are more than dozens of sales, and the settlement money will be more than tens of thousands of dollars. In the same way, the bigger the sales volume, the more the settlement money. Therefore, if it is unfortunate to be sued by EPS, it is very difficult to settle.
Other platforms are based on the settlement of frozen amounts.
